David Herman Case

Texas prison inmate David Lee Herman has been executed by lethal injection for the robbery and murder of a 21-year-old bookkeeper at a topless bar in Arlington, Texas in 1989. Herman was pronounced dead at 7:09 p.m. ‘It was horrible and inexcusable for me to take the life of your loved one and to hurt so many, mentally and physically,’ Herman said to three relatives of murder victim Jennifer Burns who attended his execution. ‘I am here because I took a life, and killing is wrong, by an individual and by the state,’ Herman said. ‘I am sorry we are here, but if my death gives you peace and closure, then this is all worthwhile. ‘To all of my friends and family, I love you. I’m going home. I’m ready.’ Burns’ mother, Paula Foster, said afterward of the crime, ‘I can’t even imagine what was going on in his head and what he felt.’ She then spoke of Herman’s execution, saying, ‘There’s a part of you that would’ve liked it to hurt a little, and would’ve liked him to feel some of the trauma and terror he put Jennifer through.’ The 39-year-old inmate attempted suicide Tuesday at a Huntsville prison unit, cutting his neck with a blade from a disposable razor. Herman was sentenced to die for the robbery-murder of Burns, who was shot along with two other employees at a club named Lace. Herman had worked at the club before the slaying

The other two employees who were shot during the crime survived and testified against Herman. Herman is the third inmate put to death in Texas this year and the 110th since the state resumed executions in 1982. Prison officials say Herman is one of six inmates slated to be executed during April. Four of the five remaining scheduled executions are expected to proceed because the inmates have exhausted their state and federal appeals. David Spence is slated to be die Thursday for the 1982 stabbings of three teenagers in a spree known as the Lake Waco killings.
