A Houston man with a previous conviction for sexual assault of a child was found guilty of capital murder Friday in the rape and beating death of a 2-year-old girl.
The state is seeking the death penalty for Kerry Dimart Allen, 41. Jurors will return Monday to state District Judge Mark Kent Ellis Jr.’s court to begin the punishment phase.
Testimony revealed that on May 10 Allen sexually assaulted and beat to death his girlfriend’s daughter, Kienna Lashay Baker. The child died from repeated blows to the chest and abdomen
During closing arguments Friday, prosecutor Marcy McNutt told jurors it was as if Kienna had been “sucker punched time and time and time again.”
The child’s mother, Kim Jones, who admitted to beating the girl in the past with a belt, told authorities she had gone to work that day and returned early when Allen called her to say there was an emergency.
The child was lying lifeless on the floor when the mother arrived. A jar of Vaseline was next to her body. A post-mortem examination later revealed she had been sexually assaulted.
Allen fled when paramedics arrived, but later turned himself in.
His lawyer, Skip Cornelius, tried to blame the mother.
Cornelius said the child could have been dead before Jones left for work that morning. He said there was no evidence, other than Jones’ account of events, to link his client to the killing and no DNA was recovered to connect him to the sexual assault.
Allen was convicted in 1986 of sexually assaulting two boys, 4 and 8.
