Paul Rougeau Case

Convicted killer Paul Rougeau became on Tuesday the fourth person to be executed this year in Texas after the failure of his request that the U.S. Supreme Court delay the procedure.

Rougeau, 46, died at 12:20 a.m. CDT Tuesday, several hours after the Supreme Court rejected his petition for a delay

Rougeau’s lawyers had filed an application with the court on grounds that Texas’ capital sentencing law was unconstitutional at the time of his original sentencing.

Rougeau’s three sisters and a niece witnessed the execution while eight family members braved a harsh thunderstorm to demonstrate outside the facility, criticizing the death penalty as a weapon against poor inmates.

The execution is the 76th to take place since the death penalty was reinstated in Texas in 1982.

Rougeau was convicted in January 1978 of killing Harris County Deputy Constable Albert Wilkins, who was shot in an attempted robbery at a tavern where he was working an off-duty security job.

In December 1982, the Texas Court of Criminal Appeals ordered a new trial, ruling that potential jurors were improperly excused after saying they had reservations about the death penalty.

Rougeau was again convicted in 1983 and returned to death row.

Wilkins, 50, begged for his life before Rougeau shot him in the head with a .38 caliber handgun during a robbery attempt at the Stock Exchange Lounge, according to court testimony. Rougeau’s younger brother, Joseph, was shot to death by police at the scene of the shooting.

Rougeau, wounded by police gunfire, was arrested about 12 hours after the slaying.
