The man who was 15 when he kidnapped, raped and murdered 8-year-old Madyson “Maddy” Middleton and then dumped her body in a recycling bin was sentenced Tuesday to juvenile prison until he turns 25 in October 2024.

Adrian “A.J.” Gonzalez, now 21, must also register for life as a sex offender, Santa Cruz County Superior Court Judge John Salazar ruled. He added that Senate Bill 1391, which prohibits juveniles from being prosecuted as adults, limited the penalties that could be imposed.

“There is no way for anyone to understand the profound and absolute pain and grief a family experiences when losing a child under these circumstances,” Salazar said.

Gonzalez pleaded guilty on April 15 to murder and numerous sex offenses and other charges. If convicted as an adult, he would have faced life in prison.

Before the sentencing, Gonzalez offered an apology, saying he hopes to one day earn the forgiveness of Maddy’s family.

“I understand there is very little I can say after all the pain and suffering I have caused,” he said. “My goal is to work on my issues so no one else has to experience what you have endured.

“I am aware that does not change the fact that I have brought you tragedy, loss and devastation. I am hopeful that, when I take the time to apologize, that you may accept my apologies for the actions that I have done and what they have brought you.”

Maddy’s father Michael Middleton said he has accepted her loss, and that he has forgiven Gonzalez.

“That does not make anything easier, it just allows me peace,” he said. “The alternative could be to hold to the darkness, but this would only consume my soul. I refuse to poison my soul and existence. Forgiveness is the only path, and I believe that Madyson would agree.”

But Middleton said that attitude should not be taken as a desire for leniency, saying that Gonzalez should have faced life in prison.

Adrian Gonzalez should never have the opportunity to repeat these crimes again,” he said.

Middleton said he doubts that rehabilitation is a possibility, considering Gonzalez’s crimes.

“A crime of this nature should not be swept under the rug, based on individuals who feel this can be remedied by rehabilitation,” he said. “I do not see this scenario as possible based on the severity and sophistication of the acts that were committed.

Maddy’s mother Laura Jordan described her daughter as “the light and love of my life.”

“(She was) the best thing I ever made,” Jordan said during an emotional, tearful statement. “She was growing up beautifully, bright, perky, fun and generous of heart.”

Jordan said that Madyson’s death left her suffering depression, anxiety and PTSD that impacted every aspect of her life and made her unable to work.

“You stole my joy, my ability to laugh through grief, leaving me with utter and complete hopelessness,” she said. “A.J., I’ve been hollowed out by your cruel, brutal, unconscionable acts, left empty and aching for my beautiful child Madyson Jordan Middleton.”

Before the hearing, about 30 people gathered outside the courtroom to protest SB 1391. Many of those people later huddled around cell phones to listen to the livestreamed hearing.

Scotts Valley resident Linda Johnson, a mother of two adult daughters, said she came to show her support for Maddy’s family.

“It’s my personal opinion that a child of 15 that plans such a heinous crime cannot be rehabilitated,” she said. “I don’t see that happening. He planned every detail.”

She said that life without the possibility of parole would have been the appropriate punishment.

“I think he’s a predator, and no child is safe around him,” she said.

Dan Middleton, Maddy’s grandfather, said that the sentencing ignores all the evidence showing that Gonzalez is a danger to society. He also predicts that SB 1391 will have dire consequences for future cases.

“I’m very disappointed in the way things are falling out,” he said. “What we’re doing here is waking people up about what will happen down the line.”

A Fairfield mother gave a tearful apology in Solano County Superior Court on Monday for the brutal slashing deaths of her twin daughters in 2010 and then was sentenced to two life terms in prison without the possibility of parole.

Monica McCarrick, 29, expressed her “deepest sorrow” for the Oct. 12, 2010, slayings of 3-year-olds Tori and Lily Ball. In June, a nine-woman, three-man jury convicted her of two counts of first-degree murder — one count for each of the girls in addition to two counts of assault on a child causing death.

The same jury also rejected her not guilty by reason of insanity plea.

I feel really bad. I pray for all of you every day and I wish there was something I could do to ease the pain for both of our families,” McCarrick said.

“I love Tori and Lily more than anything in the world. I”m so sorry,” she added.

The three-week dual-phase trial began with the emotional testimony of police and fire personnel who responded to McCarrick”s North Texas Street apartment on Oct. 12, 2010, for a report of a fire. Inside, one of the girls was nearly decapitated, and both had defensive wounds to their arms and hands, which prosecuting Deputy District Attorney Terry Ray argued were from McCarrick”s slashes with a samurai sword as they sat helpless in their high chairs.

McCarrick”s mother, Margaret, also addressed the court, attributing her daughter”s difficult childhood and mental illness for the incident and asking that she be placed in a mental facility instead of prison.

The father of the twin girls, Michael Ball, also made an emotional statement before Judge Peter B. Foor, but instead of asking for leniency, he went on to describe an “unconscionable” crime committed by the “defendant,” never referring to McCarrick by her name.

“I will miss all of the joys of my father-daughter relationship,” Ball said.

While evidence of McCarrick”s history of mental illness was presented at trial, jurors also heard evidence that McCarrick”s methamphetamine use caused her to suffer paranoid delusions. McCarrick admitted to doctors that she used the drug in the days leading up to the killings.

“One glaring fact not mentioned by any person on behalf of the defendant, and I think this was also critical in the jury”s finding, and that was this defendant”s choice of drugs,” Foor said.

“There is not a worse drug than methamphetamine,” he added.

Foor sentenced McCarrick to two consecutive life sentences in state prison, each without the possibility of parole. Two additional 25-to-life state prison sentences for the two counts of assault on a child causing death were stayed.

McCarrick was also ordered to pay $6,361 to the state Victim”s Compensation Board in addition to a $10,000 fine. McCarrick was given the opportunity to file a notice of appeal within 60 days.

Ray called the deaths of Tori and Lily Ball, “One of the most brutal murders ever.”

fter sitting dormant for nearly two years, there was some movement Friday in the appeal of the lifetime prison sentence of a methamphetamine addict Fairfield mother who butchered her twin 3-year-old daughters in 2010.

Monica McCarrick, 34, used a Samurai sword to fatally slash and repeatedly stab her daughters. A jury found her guilty in 2012 of two charges of murder and, after hearing about her troubled history of methamphetamine use, rejected her claim she was insane when she killed her daughters.

McCarrick was sentenced to life in prison without possibility of parole. She is currently locked up at a women’s prison in Chowchilla.

McCarrick apologized at her sentencing for what she did to Lili and Tori Ball on the night of Oct. 12, 2010, at their North Texas Street apartment. McCarrick tried unsuccessfully to kill herself after killing her daughters and she started a small fire, which triggered an alarm that sent police and firefighters to the apartment.

McCarrick’s appeal and the prosecution’s opposition to that appeal were filed with the Court of Appeal in 2014.

The Court of Appeal notified both sides Friday they court would hear oral arguments about the appeal at a Sept. 27 hearing in San Francisco.

McCarrick’s appeal focuses on the jury’s finding that McCarrick was not insane at the time of the murders.

McCarrick will not attend the hearing.

A man who goes by ‘Psycho’ will spend the rest of his life behind bars.

Adre Baroz was sentenced Friday after pleading guilty to first-degree murder charges. He was charged in connection with the investigation involving human remains located in the San Luis Valley area and missing persons cases in late 2020.

Baroz was charged in the murder of several people and was arrested and charged for the murder of 31-year-old Korina Arroyo of Monte Vista, as well as the murders of Myron Martinez, Shayla Hammel, Selena Esquibel, and Xavier Zeven Garcia, the grisly details of which gained nationwide attention as a manhunt began.

Conejos County law enforcement and the Colorado Bureau of Investigation were not looking for remains when they jointly executed a search warrant at a property near the town of Los Sauces on Nov. 10, 2021. They were looking for Baroz, who was wanted for allegedly stealing vehicles and equipment.

“During this search, remains were found on the property. The remains were later discovered to be human remains,” said Conejos County Sheriff Garth Crowther soon after the discovery. “This information we got at the first scene, we got a task force together … members of the task force assisted in searching a second property in close proximity to the first property. Additional human remains were found on the second property.”

Since his arrest, more have been made in connection to the human remains case.

District Judge Michael Gonzales has sentenced Adre Baroz, 29, to the Department of Corrections where he will serve five consecutive life sentences without the possibility of parole for the murders of Korina Arroyo, Selena Esquibel, Myron Robert Martinez, Xavier Zeven Garcia and Shayla Hammel.

As court documents in each case obtained by the Valley Courier revealed, Baroz brutally murdered the five people – including his youngest victim, Selena Esquibel, who was only 19 years old – over a period of time from August 25, 2020 to November 13, 2020, a space of just seven weeks.

Gonzales further sentenced Baroz to an additional total of 140 years for two counts of assault, one count of kidnapping and five counts of tampering with the remains of a deceased human body. As with the sentences for murder in the first degree, the additional sentences will be served consecutively.

Based on an average life expectancy of 76 years, Baroz was sentenced to a total of 375 years in prison.

“You’re going to be locked up for the rest of your life,” Gonzales said to Baroz.

David Lipka, defense counsel, told the court Baroz takes full responsibility for his actions and entered his guilty plea to “spare the victims’ families the pain of a court trial.” Lipka also said that extensive psychological evaluations revealed that Baroz’s actions were attributed to methamphetamine induced psychosis.

“That is not an excuse for his actions,” Lipka said. “It’s just an explanation.”

Co-defendants Julius Baroz, Adre’s older brother, and Francisco Ramirez are awaiting sentencing when court is back in session later today. This story will be updated later.

A man convicted in a road-rage shooting that killed a 6-year-old boy on an Orange County freeway was sentenced Friday to 40 years to life in prison.

Marcus Anthony Eriz, 26, of Costa Mesa, was convicted in January of second-degree murder and firing at an occupied vehicle for the deadly May 21, 2021, shooting on the freeway that killed Aiden Leos. Jurors also found true allegations of personal use of a handgun.

Aiden’s family did not attend the sentencing hearing. Eriz spoke for the first time, apologizing to Aiden’s family.

Aiden was in the back seat of his family’s car riding to kindergarten with his mother behind the wheel when he was struck by a round fired from another car. His mother testified during the trial about the heartbreaking events that unfolded nearly three years ago in the deadly freeway confrontation.

Joanna Cloonan testified that she was concerned when a white Volkswagen Golf SportWagen cut her off. The driver flashed her a peace sign, which prosecutors said Cloonan might have taken as disingenuous or sarcastic.

A shot was fired after Aiden’s mother responded by displaying the middle finger, authorities said.

Prosecutors said it was a gesture she would “regret beyond comprehension.”

Eriz was arrested following a days-long law enforcement search for the shooter.

During opening statements, a prosecutor told jurors that Eriz acted callously when he fired a round that went through the trunk of the Leos’ car and into the back seat. Aiden, strapped into a booster, was struck in the liver, lung and heart.

Aiden’s mother said she heard her son say, “Ow,” pulled to the side of the freeway as he was bleeding and flagged down an off-duty police officer. When she looked in her backseat, she said his head was hanging down. Aiden’s mother said she got her son out of his booster seat and cradled him, holding his body tightly to try and stop the bleeding, but she says she noticed “his body was dying very quickly.”

The trial included the frantic 911 call from Cloonan after she stopped on the side of the road and testimony from the off-duty-officer, a member of the Seal Beach Police Department. Cloonan is expected to testify early next week.

For days after the shooting, authorities searched for a suspect and pleaded for the public’s help. They sifted through hundreds of tips and at least half a million dollars in reward money was posted.

According to police, Eriz stashed the vehicle in a relative’s garage, shaved his beard and began pulling back his hair.

Eriz and his girlfriend were arrested outside their apartment in Costa Mesa about two weeks after the shooting. Eriz and girlfriend Wynne Lee, who is charged with being an accessory after the fact and having a concealed firearm in the vehicle, are being tried separately.

A 25-year-old man will spend over a decade behind bars for killing his father with scissors during a dispute last year.

Ventura County District Attorney Erik Nasarenko announced March 19 that Jason Fernandes was sentenced to 12 years for the death of his father, Michael Fernandes. He pleaded guilty in February to one count of voluntary manslaughter and four special allegations of use of a deadly weapon, the crime involved great violence, defendant took advantage of a position of trust, and the victim was vulnerable

According to prosecutors, on March 9, 2023, Jason Fernandes arrived at his father’s home at a senior facility and the two got into a verbal dispute. The fight turned physical when Jason Fernandes forced his way inside the unit. Witnesses reportedly saw the defendant hit the victim, and then he exited the apartment covered in blood.

The district attorney’s office said neighbors went to check on Michael Fernandes and saw that he had sustained a stab wound in his abdomen from scissors. He also suffered a stab wound and significant lacerations to his head and face. Michael Fernandes was transported to a local hospital, where he was pronounced dead.

The Ventura County Sheriff’s Office apprehended Jason Fernandes shortly after in a nearby river bottom.

Supervising Senior Deputy District Attorney Rafael Orellana who prosecuted the case said, “The conviction and sentence in this case demonstrate the defendant’s remorse and willingness to accept responsibility for this senseless killing. The victim’s death was an avoidable tragedy, and one for which today’s sentencing provides some measure of justice.”

A Ventura man was sentenced to 12 years in state prison for fatally stabbing his father with scissors last year.

Jason Tyler Fernandes, 25, pleaded guilty last month to one count of voluntary manslaughter and four special allegations: that the victim was vulnerable, that he took advantage of a position of trust, that he used a deadly weapon and that the crime involved great violence, the Ventura County District Attorney’s Office said in a news release.

On March 9, 2023, Fernandes went to a senior facility in Moorpark where his father, Michael Fernandes, was living.

“A verbal argument turned physical when Fernandes forced entry into his father’s apartment. Witnesses saw Fernandes hit his father, before leaving the apartment covered in blood,” the release said.

Neighbors found Michael suffering from a stab wound from scissors in his abdomen and “significant lacerations to his head and face.” He was declared dead at a local hospital.

The younger Fernandes was taken into custody in a nearby river bottom shortly following the attack.

“The conviction and sentence in this case demonstrate the defendant’s remorse and willingness to accept responsibility for this senseless killing,” said Supervising Senior Deputy District Attorney Rafael Orellana. “The victim’s death was an avoidable tragedy, and one for which today’s sentencing provides some measure of justice.”
