According to court documents Scotty Moore would be fired from his job by Alex Fernandez a month before the murder. Moore would go to the motel where he would shoot Alex Fernandez five times in the head causing his death

A man who shot his former boss five times during a robbery after remarking “dead people can’t talk” was executed early today.

Scotty Lee Moore, 42, was pronounced dead at 12:14 a.m. at Oklahoma State Penitentiary. He was executed for the 1983 murder of Alex Fernandez at a southwest Oklahoma City motel.

The U.S. Supreme Court rejected Moore’s final attempt for intervention Wednesday evening. Earlier in the day, it rejected two requests to stay the execution and two additional appeals.

Moore made no special requests for his last meal. He also made no arrangements for witnesses to view his execution, spokeswoman Lee Mann said. His lawyer and family visited him in his final hours

None of Fernandez’s relatives chose to view the execution.

Moore became the 16th person executed at the prison since the death penalty was reinstated in 1977.

“His death sentence has been upheld by all courts, and it is time he receives his punishment,” state Attorney General Drew Edmondson said Wednesday. “My thoughts are with the family of Alex Fernandez.

Moore had faced an execution date before. In 1994, the state attorney general’s office pressed for a date when Moore’s appeals stalled. A federal judge issued a stay that gave him more time.

Moore’s cousin and girlfriend, Vicki Caster, proved to be the prosecution’s star witness. In exchange for immunity, she testified that she accompanied Moore to the motel to help him rob it. “Dead people can’t talk,” she said he told her as they walked to the motel office.

As she collected cash at the motel desk, she said Moore led Fernandez into a rest room and then she heard shots. Fernandez was shot in the back of the head as he lay face down on the floor

Caster said Moore later told her, “You’d be dead too if you’d been shot five times in the head.” Police arrested the two a few days later in Lamesa, Texas.
