Stephen Nethery was executed by the State of Texas for the murder of a police officer

According to court documents Stephen Nethery was sexually assaulting a woman when two police officers came by. The officers did not realize they were interrupting a crime and told the pair to leave the area. Nethery would quickly apologize and then walked up to the officers and open fire striking Officer John McCarthy who would die days later in the hospital.

Capital murder charges have been filed in the ‘senseless shooting’ of a policeman who turned his back on a nude man and woman he was trying to shoo away from a dark lovers parking lot.

Officer John McCarthy, 24, was taken off life support systems Wednesday where he had been kept alive with a bullet wound in the back of his head.

Doctors said all bodily functions had ceased, except for those being maintained by the machine.

With McCarthy’s death, capital murder charges were filed against Stephen Ray Nethery, 20, who already was being held on $200,000 bond for attempted capital murder and $50,000 from an unrelated theft warrant.

About 2 a.m. Sunday McCarthy and his partner found the couple in a parking lot at White Rock Lake. Nethery was nude and the woman was partially disrobed.

Nethery instructed the couple to dress and leave and then turned to return to his patrol car.

As he turned to go, Nethery allegedly opened fire in what police say was ‘a senseless shooting.’

The other officer, Philip L. Brown, returned fire and captured Nethery as he fled toward the lake.

The woman in the car told officers she had been raped by Nethery. Police held her on investigation until Wednesday when she was released on the basis of a lie detector test.

If convicted, Nethery could be sentenced to death
