A torture killer has failed in his attempt to avoid being executed after he made a 19 year-old boy drink acid, before stoning the youngster to death. Briley Piper, 39, will remain on death row awaiting execution after South Dakota’s Supreme Court ruled his 2001 death sentence for killing Chester Poage was fair.

Piper, originally from Anchorage in Alaska, had sought to have his execution commuted to life in jail after claiming he’d had poor legal representation at the 2001 court hearing where he admitted killing Poage. He also unsuccessfully sought to be re-sentenced with new evidence about his involvement.

But South Dakota’s supreme court justices say Piper had had proper legal advice throughout, and that he’d admitted his crime entirely of his own volition. The horrific crime saw Piper and accomplices Elijah Page and Darrell Hoadley decide to ransack their friend Poage’s Rapid City home one night in March 2000.

They enticed Poage to page’s home, where he was threatened with a gun, knocked unconscious and tied up. When he came-to, Poage was made to drink acid mixed with crush pills and beer. Piper, Page and Hoadley then stripped Poage naked, before burying him in a snowy creek during freezing weather.

Poage managed to start running away, only for his torturers to catch up with him, and begin stabbing him in the neck and head.

The stricken victim begged to be taken home to die – only for the twisted trio to pick up rocks and stone him to death.

Page was executed in 2007 after admitting the murder, and opting not to file any appeals after he was convicted and sentenced to death.

Hoadley was jailed for life without parole, after a split jury decision saved him from the death penalty.

It is unclear if Piper’s attorneys plan to file any more appeals against his death sentence.

Piper is currently South Dakota’s only death row inmate.
