Texas prison officials are preparing to execute Jose Elijio De La Cruz for the slaying of a disabled Corpus Christi man. The 31-year-old De La Cruz is scheduled to receive a lethal injection after 6 p.m. CDT today at Huntsville for the June 1, 1987, beating and stabbing death of 24-year-old Domingo Rosas during a robbery.
The victim suffered from epilepsy and partial paralysis stemming from a childhood accident. He lived alone in an apartment and collected a monthly disability check. De La Cruz has waived all appeals in the case, becoming what prison officials call a ‘volunteer’ for execution. According to the evidence, De La Cruz killed Rosas and stole his television, VCR and stereo, which he sold for about $80. The crime occurred the morning after De La Cruz had been a guest in Rosas’ home, where the two men had played a drinking game. That night De La Cruz was arrested for public intoxication after running a borrowed car into a ditch. Arresting officers discovered in De La Cruz’s possession a large blood-stained knife and bottle of medicine prescribed for Rosas. De La Cruz told officers at his booking that he was Rosas, and he was later released from jail. He was arrested two days later after attempting to withdraw $350 from a Corpus Christi bank using Rosas’ identification card. De La Cruz said he did not know Rosas’ body had been discovered when he went to the bank. De La Cruz would be the 11th Texas death row inmate executed this year and the 175th since the state resumed the death penalty in 1982
