Fabian Hernandez Case

An El Paso gang member’s execution for a double murder committed during a jealous rage was postponed.

Fabian Hernandez, 44, was set to die Thursday until the Texas Court of Criminal Appeals ordered a delay as the state deals with the coronavirus pandemic

Hernandez was on death row after being convicted of fatally shooting his estranged wife, Renee Urbina Hernandez, 28, and one of her friends, Arturo Fonseca, 24, in front of her parents’ West Side home on Nov. 3, 2006.

Days before Thanksgiving 2009, an El Paso jury convicted Hernandez of capital murder and sentenced him to the death penalty.

Hernandez, known by the moniker “Spook,” was a Barrio Azteca gang member who as a teenager did time for manslaughter in a fatal shooting in Doña Ana County

The Texas Court of Criminal Appeals on April 1 issued a 60-day delay for Hernandez’s scheduled execution set for April 23, the Associated Press reported

The state’s highest criminal court did not give a reason for Hernandez’s stay, but the postponement followed two executions that were ordered delayed in March because of COVID-19 concerns, the Associated Press reported.

An execution date has not been rescheduled.

The Texas Department of Criminal Justice’s website lists its next scheduled execution on May 6 for convicted killer Edward Lee Busby Jr. of Tarrant County.
