Emmitt Foster Case
Convicted killer Emmitt Foster, 42, was executed by lethal injection early Wednesday in Missouri. Foster was pronounced dead from lethal injection at 12:32 a.m. Wednesday at the Potosi Correctional Center, about 60 miles south of St. Louis. He died shortly after being administered separate doses of three drugs, which have a lethal effect when combined. Foster had requested no personal witnesses to be present for his execution, which took place after the U.S. Supreme Court denied a stay late Tuesday.
Foster’s execution had been delayed last Friday when a three-judge panel of the 8th U.S. Circuit Court of Appeals in St. Louis ordered a hearing on his claim of new evidence in his case. Foster was ordered put to death for the 1984 slaying of an acquaintance during a robbery. Missouri Attorney General Jay Nixon asked the full appeals court to reinstate the execution, which it did, voting 9-2 Monday to overrule the panel. The vote canceled the hearing and cleared the way for the death sentence to be carried out.
The execution went forward after a final request for a stay was rejected by the Supreme Court late Tuesday. Foster, 42, was convicted of the November 1984 murder of Travis Walker, 26, his teammate on a softball team in St. Louis. Walker was forced to lie on the floor of his apartment during a robbery and was shot in the head four times, prosecutors said. The killers also fired four shots into the head of Walker’s roommate, Deann Keys, but she survived and identified the assailants.
Foster’s accomplice, Michael Phillips, was convicted in a separate trial and sentenced to life in prison. He also had been a member of the same softball team as Foster and Walker.
During the trials of the two killers, Keys testified they had demanded jewelry and other valuables from the victims. Foster has previous convictions for armed robbery, burglary and illegal possession of U.S. mail. In his claim of new evidence in the case,
Foster cited a sworn statement given last year by Phillips, in which Phillips claimed he and an unidentified man ‘committed the acts that brought about the death of Travis Walker.’ Phillips stated he was afraid to identify the real killer because he believed he would be killed if he did so.
Missouri’s last execution occurred Oct. 6, 1993, when Frank Guinan was put to death at Potosi for the murders of two prison inmates. Since then, the U.S. Supreme Court has granted stays that prevented two other executions. Missouri has executed 11 killers since 1989, when it resumed using the death penalty under current Supreme Court rules. The state has 88 men and three women awaiting execution on death row.
