A jury found Facundo Chavez guilty of capital murder for the killing of El Paso County Sheriff’s Deputy Peter Herrera.

The jury deliberated for about 40 minutes after hearing closing arguments Thursday morning.

Chavez shot and killed Herrera during a traffic stop in San Elizario on March 22, 2019.

His sentencing will be on Friday at 9 a.m.

Chavez could face the death penalty or life in prison without parole

El Paso District Attorney Bill Hicks will hold a press conference at 5 p.m. regarding the case.

In the closing arguments the state asked the jurors to find Chavez guilty based on the facts that were presented during the trial and the defense asked them to instead consider the influence that Chavez’s ex-girlfriend had on him the night of the shooting.

Michelle Hill the prosecutor for the state of Texas began the state’s closing argument by telling the jury that the actions of Herrera from the day of the shooting were admirable and not questionable.

Hill went on to say Herrera was doing his job and was doing it well before adding.

“The only thing Deputy Herrera did wrong was underestimate the defendant,” said Hill.

Leonard Morales the defense attorney for Chavez began his arguments by saying “we are not sane, we are not blind but we are asking you consider the elements.”

The defense argued that the traffic stop changed from a routine stop to a drug bust.

The defense said Hererra was trying to move from patrol to the narcotics division.

Morales asked the jury to consider how information coming from Chavez’s ex-girlfriend Arlene Pina could have influenced him to shoot Herrera.

“He was not alone, there was a devil on his shoulder named Arlene Pina. Had it not been for her maybe these two would’ve never met. In the end Facundo Chavez killed Deputy Herrera, but we all needed you to know why,” said Morales.

Before the jury was dismissed for deliberations the state prosecutor William Dixon played Herrera’s dash cam video for the jury one last time.

Dixon pleaded to the jury to consider Chavez’s history calling him a “psychopath” and a convicted felon with a gun and a drug dealer.

Dixon wrapped up his arguments by saying to the jury “I don’t care what was going on through his mind. I care that he knowingly and intentionally acted.”
