Tyler Bartley Case
An 18-year-old man who worked as a clerk at an East Akron drive-thru was sentenced Wednesday to life in prison for shooting and killing a customer.
Tyler Bartley, of Akron, was sentenced after pleading guilty in March to a murder charge for the killing of Patrick Boergert, 47, at Border’s Drive Thru, 1365 S. Arlington St., Summit County Prosecutor Elliot Kolkovich said in a news release
Prosecutors say Boergert was a passenger in his friend’s car in February 2024 when they arrived at the drive-thru where Bartley was working as a clerk. Upon seeing Boergert, Bartley fired multiple shots into the vehicle. Reports did not give a possible motive for the shooting.
The driver quickly fled the scene and called 911. Boergert was later pronounced dead at a hospital.
Prosecutors say store surveillance video showed Bartley shooting into the vehicle. There also were witnesses to the shooting.
According to his obituary, Boergert was a Cleveland native. He is survived by four daughters, three sons and seven grandchildren.
Tyler Bartley News
Hours before an Akron teenager was scheduled to appear for jury selection, he pleaded guilty to shooting and killing 47-year-old Patrick Boergert of Barberton last year.
Tyler Bartley, 17, accepted a plea agreement with Summit County prosecutors to avoid trial. He pleaded guilty to one count of murder and a firearm specification that carries a mandatory one year in prison.
Prosecutors dismissed his other charges: murder, tampering with evidence, two counts of felonious assault and three three-year firearm specifications.
“No grievance should ever escalate to this level of violence,” Summit County Prosecutor Elliot Kolkovich said in a news release. “Our thoughts remain with Patrick Boergert’s family and loved ones as they grieve this unimaginable loss. I also want to recognize the efforts of the first responders who did everything they could to save Boergert’s life.”
Attorneys John P. Alexander and Edward T. Smith represent Bartley. He will be sentenced at 1 p.m. June 4.
What happened?
The incident occurred the night of Feb. 23, 2024, when Boergert and his friend drove to Borders Drive Thru on South Arlington Street, prosecutors said. Bartley, who worked as a drive thru clerk, reached through the car back window of the vehicle and shot Boergert in the torso.
Boergert’s friend drove him away to the 800 block of East Wilbeth Road and called 911. He was taken to Summa Health Akron City Hospital, where he was later pronounced dead.
